Web Scraping and Data Harvesting Unauthorized web scraping, data mining, or any form of automated collection of data from our website or any SHE IS MARI–associated account on any platform is strictly prohibited. Such activity may result in termination of access and potential legal action under applicable federal computer fraud and abuse laws and Massachusetts data protection statutes.

2. Intellectual Property and Copyright All images, quotes, and similar content displayed on this website are used in compliance with the fair use provisions of U.S. Copyright Law (17 U.S.C. §107). Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts (including but not limited to M.G.L. c. 93A – Massachusetts Consumer Protection Act, and 201 CMR 17.00 – Massachusetts Data Security Regulations) and the federal laws of the United States. Any disputes shall be exclusively subject to the jurisdiction of the state and federal courts located within Massachusetts.

IV. Appointments and Consultations

1. Complimentary Consultations SHE IS MARI currently offers consultations and services on a complimentary basis. Appointment requests are subject to waitlisting and confirmation.

2. Scheduling Appointments must be scheduled remotely via Microsoft Teams. No payments are accepted for these complimentary sessions at this time.

3. Termination and Right to Refuse Service SHE IS MARI reserves the right to refuse service to any person and may terminate any session or consultation at its sole discretion without prior notice.

V. Recordings and Consent

1. Recording of Sessions All consultations and sessions may be recorded for quality, training, and liability purposes. Such recordings are the exclusive property of SHE IS MARI.

2. Use and Distribution Any use, sharing, sale, or distribution of recorded content is strictly prohibited without prior written consent from SHE IS MARI. Consent requests should be submitted to: legal@sheismari.com

3. Retention and Use for Testimonials SHE IS MARI reserves the right to retain recorded sessions and may use anonymized excerpts as testimonials.

VI. Resumption of Paid Services

SHE IS MARI reserves the absolute right to transition from complimentary to fee-based consultations and services at its sole discretion. This provision applies to all appointment requests, regardless of the submission date.

VII. Payment and Order Terms

1. Payment Methods

   • All products require full prepayment at the time of purchase.

   • Invoices, which include detailed payment links, are sent by email.

   • Credit and debit card payments are processed securely through third-party providers (e.g., PayPal, Apple Pay, Cash App, Zelle, Venmo).

   • Consumers must verify payment account ownership and include the appropriate invoice number with each payment.

2. Order Fulfillment

   • Product availability is subject to supplier inventory, purchase limits, backorders, and pricing fluctuations.

   • SHE IS MARI reserves the right to modify or adjust orders if conditions change. Consumers will be promptly notified.

3. Refunds and Exchanges

   • Approved refunds and exchanges may be subject to processing fees. Consumers are encouraged to confirm all costs and product availability prior to placing orders.

4. Gift Cards

   • Gift cards are non-refundable.

   • They may be delivered electronically or as printed copies upon request.

   • Printed gift cards are subject to a handling fee and shipped via USPS or another tracked service. Requests must include the relevant order or invoice number and be sent through the chat feature of the website.

VIII. Claims Process and Returns

1. Claims Submission

   • Claims must be submitted within 12 hours of delivery.

   • Submissions must include the order or invoice number, a description of the issue, and supporting evidence (photos/videos).

2. Damaged or Malfunctioning Products

   • Consumers must provide documentation of packaging and product condition.

   • For defective products, detailed evidence is required.

3. Return Conditions

   • SHE IS MARI may require product returns before issuing replacements or refunds.

   • Approved returns may incur additional fees depending on supplier policies.

XII. Miscellaneous

1. Discontinuance and Modifications SHE IS MARI reserves the right to discontinue, modify, or suspend any product, service, or part of this agreement at its sole discretion without prior notice.

2. Severability If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

3. Entire Agreement These Terms, together with any referenced policies, constitute the entire agreement between you and SHE IS MARI regarding your use of the website and services.
